1. Acceptance of Terms

Welcome to 90 Minutes a Week. By accessing or using any of our mobile applications, websites, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all apps and services offered under the 90 Minutes a Week brand, including but not limited to relationship wellness apps, conversation tools, and related services.

2. Description of Services

90 Minutes a Week provides a suite of mobile applications and digital tools designed to help couples strengthen their relationships through intentional communication, guided exercises, and practical resources. Our services include:

  • Mobile applications for iOS and Android devices
  • Guided conversation prompts and exercises
  • Progress tracking and reminders
  • Premium subscription features
  • Educational content and resources

3. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

4. User Accounts

4.1 Account Creation

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Be responsible for all activities under your account

4.2 Account Termination

You may delete your account at any time through the app settings or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

5. Subscriptions and Payments

5.1 Subscription Plans

Certain features require a paid subscription. Subscription options and pricing are displayed in the apps and may vary by region. Subscriptions may include:

  • Weekly, monthly, or annual billing cycles
  • Auto-renewal unless cancelled
  • Access to premium features and content

5.2 Billing and Payment

Subscriptions are billed through:

  • Apple App Store (for iOS)
  • Google Play Store (for Android)
  • Other payment processors as indicated

By purchasing a subscription, you authorize us (or our payment processor) to charge your payment method. All fees are non-refundable except as required by law or as expressly stated in these Terms.

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your payment method will be charged within 24 hours prior to the start of each renewal period. You can manage or cancel your subscription through your app store account settings.

5.4 Price Changes

We reserve the right to change subscription prices with reasonable notice. Price changes will not affect your current subscription period but will apply upon renewal.

5.5 Free Trials

We may offer free trial periods for new subscribers. If you do not cancel before the trial ends, you will be automatically charged for a full subscription period. We reserve the right to limit free trial eligibility.

6. Refund Policy

For subscriptions purchased through the Apple App Store or Google Play Store, refund requests must be made directly through those platforms in accordance with their refund policies. We do not have direct control over these refund processes.

For subscriptions purchased directly through our website or other channels, please contact us at jacoblipsky.dev@gmail.com to discuss refund requests. Refunds are evaluated on a case-by-case basis.

7. User Content and Conduct

7.1 Your Content

You retain ownership of any content you create, submit, or share through our Services ("User Content"). By using our Services, you grant us a limited, non-exclusive license to use, store, and display your User Content solely to provide and improve our Services.

7.2 Prohibited Conduct

You agree NOT to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Impersonate any person or entity or misrepresent your affiliation
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers
  • Use automated systems (bots, scrapers) without our permission
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Collect or harvest user information without consent
  • Share content that is abusive, threatening, defamatory, or discriminatory
  • Share explicit sexual content or pornography

8. Intellectual Property

8.1 Our Content

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio, video, software, and design, are owned by 90 Minutes a Week or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. This license does not include:

  • Modifying or copying our content
  • Using content for commercial purposes
  • Removing copyright or proprietary notices
  • Transferring content to another person or entity

8.3 Trademarks

"90 Minutes a Week" and related logos are trademarks owned by us. You may not use these trademarks without our prior written permission.

9. Medical and Professional Disclaimer

IMPORTANT: Our Services are designed to support relationship wellness and are NOT a substitute for professional counseling, therapy, or medical advice. We do not provide medical, psychological, or legal advice.

  • If you are experiencing a mental health crisis, domestic violence, or relationship abuse, please contact appropriate emergency services or professional help immediately
  • Our apps provide general educational content and tools, not personalized professional advice
  • You should consult qualified professionals for relationship counseling, therapy, or mental health support
  • We make no guarantees about the effectiveness of our tools or their impact on your relationship

10. Disclaimers and Limitations of Liability

10.1 No Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • The results from using the Services will be accurate or reliable
  • Any defects will be corrected
  • The Services will meet your specific needs or expectations

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 90 MINUTES A WEEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

  • Your use or inability to use the Services
  • Any unauthorized access to or use of our servers or your data
  • Any bugs, viruses, or harmful code transmitted through the Services
  • Any errors, inaccuracies, or omissions in content
  • Any decisions made or actions taken based on content in the Services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless 90 Minutes a Week, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your use of the Services
  • Your User Content
  • Your violation of any third-party rights

12. Third-Party Services and Links

Our Services may contain links to third-party websites or integrate with third-party services (e.g., Apple Sign-In, Google Sign-In, payment processors). We are not responsible for:

  • The content or privacy practices of third-party sites
  • Any damages arising from your use of third-party services
  • The availability or functionality of third-party services

Your use of third-party services is subject to their terms and policies.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using our Services, you agree to our Privacy Policy.

14. Modifications to Services

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Services at any time
  • Change features, functionality, or content
  • Impose limits on certain features or access

We are not liable for any modifications, suspensions, or discontinuations.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by:

  • Posting the updated Terms in our apps and on our website
  • Sending email notification (if you have an account)
  • Displaying an in-app notification

Your continued use after changes indicates acceptance of the updated Terms. If you do not agree, you must stop using the Services.

16. Termination

We may terminate or suspend your access to the Services immediately, without notice, for:

  • Violations of these Terms
  • Fraudulent, abusive, or illegal activity
  • At our discretion for any reason

Upon termination:

  • Your right to use the Services ceases immediately
  • We may delete your account and data
  • You remain liable for any outstanding payments

17. Dispute Resolution and Arbitration

17.1 Informal Resolution

Before filing a claim, you agree to contact us at jacoblipsky.dev@gmail.com to attempt to resolve the dispute informally.

17.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court. Arbitration will be conducted under the rules of the American Arbitration Association (AAA). The arbitrator's decision is final and binding.

17.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

17.4 Small Claims Exception

Either party may bring an individual action in small claims court instead of arbitration.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. For any disputes not subject to arbitration, you agree to the exclusive jurisdiction of the courts in Israel.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 90 Minutes a Week regarding the Services and supersede all prior agreements.

21. Assignment

You may not assign or transfer these Terms or your rights without our written consent. We may assign these Terms to any affiliate or successor without restriction.

22. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

23. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, or technical failures.

24. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use the Services in any country subject to embargo or export restrictions.

25. Feedback

If you provide us with feedback, suggestions, or ideas about our Services, you grant us the right to use, modify, and incorporate such feedback without compensation or obligation to you.

27. Apple App Store Specific Terms

If you access our Services through the Apple App Store:

  • These Terms are between you and 90 Minutes a Week, not Apple
  • Apple has no obligation to provide support or maintenance
  • Apple is not responsible for the app or content
  • Apple is not liable for any claims related to the app
  • You must comply with Apple's App Store Terms of Service
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

28. Google Play Store Specific Terms

If you access our Services through Google Play Store:

  • These Terms are between you and 90 Minutes a Week, not Google
  • Google has no obligation or liability related to the app
  • You must comply with Google Play's Terms of Service

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
